3. Third-Party Integrations and Email Tracking
a. Functionality:
Podseeker may offer integrations with third-party services, such as Google Mail ("Gmail"), allowing you to send emails directly from our platform using your third-party account (e.g., Gmail). In connection with Gmail, Podseeker only requests permission to send emails on your behalf using the gmail.send scope. Podseeker does not request or access permission to read, view, or manage the content of your email inbox or messages.
b. Authorization:
To use such integrations, you may be required to authenticate your third-party account (e.g., your Google Account) and explicitly authorize Podseeker to send emails on your behalf, as described during the authorization process and in our Privacy Policy. Podseeker does not request access to view, read, or store your emails.
c. User Responsibility:
When using integrations like the Gmail feature:
i. You are solely responsible for the content of any communications (e.g., emails) sent via the integration using your account.
ii. You agree to comply fully with the terms of service, acceptable use policies, and other rules of the third-party service provider (e.g., Google/Gmail). Podseeker is not responsible for your compliance or non-compliance.
iii. You acknowledge that sending emails via this integration uses your own third-party account (e.g., your Gmail sending limits and reputation). Podseeker is not responsible for deliverability issues, emails marked as spam, or any blocks or limitations placed on your third-party account resulting from your use of the integration.
iv. You understand and agree that Podseeker does not access, read, or store the content of your Gmail inbox, received emails, or any messages other than those emails you specifically send through the Podseeker platform.
d. Reliance on Third Parties:
The functionality and availability of third-party integrations depend on the respective third-party providers (e.g., Google). Podseeker does not control these third-party services and is not responsible for their availability, performance, or any changes they make to their services or APIs that may affect the integration. Features relying on these integrations may become temporarily or permanently unavailable without prior notice due to actions by the third party.e. Data Handling:
Podseeker only accesses the minimal information necessary to send emails you initiate from your connected Gmail account. Podseeker does not read, index, analyze, or store the content of your Gmail inbox or any received messages. Your use of third-party integrations is subject to our Privacy Policy, which details how we handle any data accessed via these integrations, and Section 3A ("Email Tracking") of these Terms.
3A. Email Tracking
a. When you use Podseeker to send emails through a connected Gmail account, your emails may include an invisible tracking pixel (a small, transparent image) that allows you, as the sender, to see if and when the recipient has opened your email.
b. The tracking pixel collects only information related to the open status (such as the time the email was opened and the recipient’s email address) and does not collect further information about the recipient.
c. Open tracking is provided solely for your convenience as the sender; this information is not shared with other parties except as required by law, or as expressly described in our Privacy Policy.
d. If you do not wish to include tracking pixels in your outgoing emails, you may disable this feature in your Podseeker account settings.
The materials and services (including any third-party integrations) on PodSeeker’s website are provided on an ‘as is’ basis. PodSeeker makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement of intellectual property or other violation of rights, or the availability, reliability, accuracy, or security of the service or any integrated third-party services (like Gmail).
Further, PodSeeker does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials or the service on its website or otherwise relating to such materials or on any sites linked to this site. Use of features relying on third-party integrations is at your own risk.
In no event shall PodSeeker or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials or services on PodSeeker’s website, including any damages arising from the use, non-availability, or failure of integrated third-party services (such as the Gmail integration), even if PodSeeker or a PodSeeker authorised representative has been notified orally or in writing of the possibility of such damage. However PodSeeker does not make any commitment to update the materials.
PodSeeker has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by PodSeeker of the site. Use of any such linked website is at the user’s own risk.
PodSeeker may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.
These terms and conditions are governed by and construed in accordance with the laws of the Republic of Singapore, and you irrevocably submit to the exclusive jurisdiction of the courts of Singapore.
Whilst we do have an 'unlimited' plan, this does not mean the customer can export endlessly until they have huge portions of our proprietary database. If we notice an 'unreasonably high' number of data exports we reserve the right to block that user from our software and will refund them their most recent payment.
